경제범죄에서의 디지털 증거 증거능력 판단 기준

현대 기업 활동의 많은 부분들이 디지털 및 네트워크 기술에 의존하고 있어, 전자정보를 대상으로 하 는 디지털 증거에 대한 강제처분은 그 적정화 및 합리화가 시급하다. 경제범죄에 있어서 압수수색이 지 나치게 포괄적이고 광범위하게 이루어진다는 비판과 함께 이것이 정상적인 기업 활동이나 업무에 지장 을 초래하고 있다는 문제의식이 꾸준히 제기되어 왔기 때문이다. 이것은 주로 서류 전체 혹은 컴퓨터 장비 일체를 수사기관으로 이전한 다음 장기간에 걸쳐 대량의 정보를 대상으로 은밀한 탐색을 하는 압 수수색 관행에 기인한다. 디지털 증거도 다른 증거와 마찬가지로 위법수집증거 배제법칙, 전문법칙이 적용된다. 다만 디지털 증거의 경우에는 다른 증거와 구별되는 디지털 증거 본래의 특징으로 인하여 종래 전통적인 증거를 상 정하고 형성된 법령 및 법리를 조화롭게 해석하여 적용할 필요가 생긴다. 이러한 점에서 볼 때, 디지털 증거의 증거능력 판단에 대해서는 같은 원칙이 적용되나 구체적으로 적용되는 양상은 달라질 수밖에 없다. 또한 그 기술적 특성을 반영하여 기술적 수단에 의한 객관적 정황을 기초로 전문증거의 진정 성 립을 증명할 수 있게 하는 등의 입법적 필요성도 제기될 수 있다. 이하에서 디지털 증거 증거능력 판단에 관한 기준을 위법수집증거 배제법칙, 디지털 증거의 특수성, 전문법칙 등 세 가지의 관점에서 검토해 보고, 증거능력 판단을 위해 고려해야 할 실무상 기준을 제안해 본다.

Determining the Admissibility of Digital Evidence in Economic Crime

Much of modern business activities rely on digital and network technologies, and it is imperative that the legal disposition of digital evidence for electronic information be adequately and rationalized. It is because of the criticism that a search and seizure is overly comprehensive and extensive in economic crime, and that it has been constantly raising the awareness that this is hindering normal business operations and activities. This is largely due to the search and seizure practices, which involves moving all of the paperwork or all of the computers to an investigative agency and then secretly searching for massive amounts of information over a long period of time. Digital evidence, like any other evidence, is subject to the exclusionary rule of the illegally obtained evidence and hearsay rule. However in the case of digital evidence, due to its inherent characteristics, which is different from other evidence, there is a need to harmoniously interpret and apply laws and statutes that have been established based on conventional evidence. From this point of view, the same principle applies to judging admissibility of digital evidence, but the way in which it is specifically applied is different. In addition, there may be a legislative need to reflect the technical characteristics and to prove the authenticity of the professional evidence based on the objective circumstance by technical means. In this study, we will examine the criteria for judging the evidence admissibility of digital evidence from three perspectives such as the exclusionary rule of the illegally obtained evidence, the specificity of digital evidence, and the hearsay law, and propose practical standards to be considered for judging evidence capability.
