주거복지실현을 위한 주택관리사법 제정방안 연구 - 공동주택관리의 효율성 달성을 위한 주택관리사법 제정을 중심으로 -

1960년대 이후 산업화로 인한 인구의 도시집중과 함께 한국의 주거형태는 단독주택에서 공동주택으 로 급속하게 변화해 왔다. 2018년 현재 주택보급률은 103%에 이르고 있으며, 우리나라 국민의 약70%가 공동주택에 거주하고 있고 그중 대단위 공동주택인 아파트의 거주비율은 60%에 달하고 있는 상황이다. 공동주택으로의 주거문화의 확산은 생활공간을 공유하는 이웃과의 괴리현상에 기인한 층간갈등, 소통 부재, 관계단절 등의 문제를 끊임없이 발생시킴으로써 심각한 사회문제로 나타나고 있다. 2018년 통계청 인구총조사 기준 우리나라 전체국민의 수 약 5,160만명 가운데 아파트 등 공동주택 거주자의 수는 약 3,200만명인 70%로 나타나고 있으며 공동주택의 거주자의 비율이 지속적으로 높아 지면서 공동주택의 유형도 고밀도·고층화로 변화되어가고 있는 상황이다. 공동주택의 경우 건축물의 생애기간과 소유기간의 불일치로 인하여 현재의 소유주와 미래의 소유주 간의 주택관리에 있어서 관리 및 수선에 있어서 비용부담주체의 불명확성이 발생하고 있다. 또한 공동 주택의 증가에 따른 공동주택관리의 전문화·체계화의 사회적 요구에도 불구하고 「공동주택관리법」 상 공동주택의 관리대상을 “의무관리대상 공동주택”과 “임의관리대상 공동주택”으로 구분하여 공동주택 의 관리업무의 혼선을 초래하고 있으며 공공재로서의 성격이 큰 공동주택의 관리업무에 있어서 한계를 노출하고 있다. 공동주택 주거문화의 확산은 전문적·체계적 공동주택관리를 통한 공동주택 거주자의 삶의 질의 개선을 위한 공동주택관리의 제도적 개선을 끊임없이 요구하고 있다. 의무관리대상 공동주택의 경우는 「주택법」과 「공동주택관리법」의 적용에 근거하여 주택관리업 체 및 주택관리사의 고용에 따른 체계적 관리가 가능하지만 임의관리대상 공동주택의 경우는 정부 및 지방자치단체의 관리의 사각지대에 위치하여 거주자에 의해 관리비용의 부담을 줄이기 위해 임의적으 로 관리되는 것이 현실이다. 국민다수의 공동주택으로의 주거유형변화를 고려할 때, 공동주택의 전문적·체계적 관리를 통한 거주 민을 위한 질적 주거환경의 개선과 주거복지의 실현이 필수적이다. 거주민을 위한 질적 주거복지의 실 현은 공동주택관련 제도의 개선과 함께 공동주택관리의 주체인 주택관리사업무의 기능과 역할의 강화 와 신분보장이 함께 수반되어야 할 것이다. 주택관리의 질적 개선을 위해서는 「공동주택관리법」에서 「주택관리사법」으로의 분법을 통하여 타 자격사와 같이 주택관리사의 전문성을 향상할 수 있는 제도 적 기반의 조성이 필수적이라고 할 수 있다.

A Study on the Establishment of the Qualification Act for Housing Manager for the Realization of Housing Welfare

Until now, Korea's housing culture has rapidly changed from an individual home to apartments. Korea's housing supply rate stands at 103 percent, with about 70 percent of the population living in apartments. The spread of apartment housing culture has emerged as a new social issue by deriving problems such as lack of communication with neighbors and breakdown of relationships. In our population of 51.6 million,, The number of residents living in apartments stands at 32 million and 70 percent. As the proportion of apartments continues to rise, apartment buildings are becoming more dense and high-rise. It is difficult to manage apartment professionally by the establishment of systematic goals despite the increasing demand for housing management. Thus, The needs of systematic apartment management is constantly required. By establishing the systematic goals of housing management, apartment can be managed systematically according to the application of the Housing Act and the Housing Management Act. Considering the formation of residential trends into apartments, residents' residential welfare will be realized through the management of systematic apartment based on an efficient legal system. Also, the realization of residential welfare for residents should be accompanied by the guarantee of the welfare and status of housing manager as the main body of apartment management. In addition, the realization of residential welfare seems essential to improving the professionalism of housing manager like other people with a professional certificate, through the separation of the Qualification Act for Housing Manager from the Apartment Housing Management Act. The enactment of the Qualification Act for Housing Manager will greatly contribute to the improvement of the residential environment and the realization of residential welfare.
